Terms & Conditions

Layback Surfcamp S.L.
(English Version – Non-binding Translation)


§1 Scope & Contracting Party

These Terms & Conditions apply to all contracts between Layback Surfcamp S.L., Spain (hereinafter referred to as “the Organizer”), and the customer.

Depending on the booking, the services constitute either:

  • a package travel arrangement (e.g. accommodation combined with surf courses), or
  • individual services (e.g. surf lessons or equipment rental only).

§2 Conclusion of Contract

The contract is concluded when:

  • the customer submits a booking (online, by email, or by phone), and
  • the Organizer confirms the booking or accepts payment.

§3 Services

The scope of services is determined exclusively by:

  • the booking confirmation, and
  • the service descriptions published on the Organizer’s website at the time of booking.

§4 Participation Requirements & Health

Participation in surf courses and sports activities requires:

  • normal physical fitness,
  • swimming ability,
  • no known medical conditions preventing participation.

Participation is at the customer’s own sporting risk, without prejudice to the Organizer’s statutory duties of care and safety.


§5 Minors

Minors may participate only with written consent from a parent or legal guardian.
No supervision is provided outside scheduled course times.


§ 6 Cancellation by the Customer

The customer may withdraw from the contract at any time prior to the start of the trip. The date on which the cancellation notice is received by the provider shall be decisive.

In the event of cancellation, the following flat-rate cancellation fees, based on the booked total/package price and independent of the amount of any deposit paid, shall apply:

  • up to 30 days before the start of the trip: 20% of the booked package price
  • 29–15 days before the start of the trip: 50% of the booked package price
  • 14–8 days before the start of the trip: 80% of the booked package price
  • from 7 days before the start of the trip, or in case of no-show: 100% of the booked package price

Any deposit already paid shall be credited against the cancellation fees. If the payments made exceed the applicable cancellation fees, the difference shall be refunded.


§7 Substitute Participant

The customer may nominate a substitute participant prior to the start of the trip.
An administrative fee of €30 applies.


§8 Changes to Services

Minor changes to services are permitted provided that:

  • they are objectively justified, and
  • they do not substantially alter the overall character of the booking.

§9 Force Majeure

In the event of unavoidable extraordinary circumstances (e.g. natural events), either party may withdraw from the contract.
Services already provided may be charged proportionally.


§10 Liability

The Organizer is liable for:

  • intent and gross negligence,
  • injury to life, body, or health.

The Organizer is not liable for:

  • typical sporting risks when activities are conducted properly,
  • services provided by third parties (e.g. flights).

§11 Duty to Cooperate

Any defects or issues must be reported immediately on site in order to allow remedial action.


§12 Limitation Period

Claims are subject to the statutory limitation periods under Spanish law.


§13 Photo & Video Recordings

Photo and video recordings may be made during the stay and used for marketing purposes.
The customer may revoke consent at any time with effect for the future.


§14 Applicable Law & Jurisdiction

Spanish law shall apply.
Mandatory consumer protection provisions of the customer’s country of residence remain unaffected.
